The "common use" term is one of the arguments before SCOTUS against the bans. Not a definition to be determined by the State. That is not what the court is deciding. Now this could cause an issue when laser weapons, plasma rifles and other future technology in weapons development comes along and...

OK so on a serious note, SCOTUS decisions apply to all circuit courts and states. Meaning the AR15 in Texas is the "in common use" argument and would be common use weapon for NY that they will have to abide by.
