Elite Precision v. ATF: What the new interstate-handgun ruling really means for New Yorkers

The Fifth Circuit struck down the federal restriction on direct interstate handgun sales—but New York is governed by the Second Circuit, which upheld the restriction in United States v. Vereen.

So, no: this does not change how New Yorkers may legally receive an out-of-state handgun today.

The interesting part is the reasoning. The Fifth Circuit said the government cannot avoid constitutional scrutiny merely because a buyer can use a slower, more expensive route involving a required intermediary.

Full New York-focused breakdown:
Elite Precision v. ATF: What It Means for New York

Where should the constitutional line be?

Is a home-state FFL transfer a reasonable compliance step—or does it become an unconstitutional barrier when it adds substantial fees, delay, travel, or the possibility that no dealer will handle the transfer?

Even if today anybody from any state could buy a handgun from somebody in a different state we in NY still have to have it added to our CCW permit before we can take possession of it. So even if everything changed we are still basically handicapped because of that.

That’s possession in NYS though. You could buy it and store it in PA, have it added then bring it back. It still sucks, but would be convenient for some.
I despise this rule. There are a few guns I wanted to buy off here, but the whole process of adding it to the permit and making two trips ruins it for me. There’s a Ruger single 6 on here now I’d buy but it’s 2.5 hour drive one way for me. Doing this 4 times makes no sense to me.

Lee Harvey Oswald would have approved of this message.

Lettem build ghost gun glocks, and be done with it, until, arrest. Oops, that is how it is today anyway.

Sending you 2nd cousin in jail a handgun, for when the gets out is a no no; It ain't 1955 no more.

…unless they are willing to ship to a FFL or you know a FFL willing to travel and pick it up.

The process is invasive, unnecessary, and painful by design. But there are ways to ease the pain if you pause to figure it out.

You really think the GCA would have prevented Oswald from getting a gun ?

We should try that with drugs. If nobody can get them nobody will ever overdose, right ?

That’s what I mean. How many PA dealers know about handgun coupons or how they work? Not to mention I doubt it would make sense to go thru all that for buying a handgun from a dealer 6 or 7 states away. Heck for most people in NY it’s a pain to buy a handgun that’s at a dealer in a different NY county.

Where do you think the criminal get their Grocks (home built or otherwise)? "Switches" sure as hell aren't legal, but that hasn't done anything more than make acquisition costs and black market profits higher.
If they aren't smart enough to use a computer or get an ID, what makes you think they could make their own? Given the number of safety violations resulting in death and dismemberment from unsafe showing off I'd say very few are made by Home Boy's, but that's raciest, besides, aren't they entitled to the same Second Amendment as any other god fearing American? These questions make democrats squirm.

Oswald was the democrats poster boy for passage of the GCA. I believe the democrats had a seditious and conspiratorial plan to seize total control over the government, but luckily for the Country, they always fuck things up including their own plans to overthrow the government.
