Hahahaha

I never liked these so called hypothetical scenarios!

But FACT is ... You have a RIGHT TO DEFENSE. This simple fact was codified by the SCOTUS. NY State and all it's bullshit cannot remove this RIGHT. All that need be present is your genuine fear for your life or safety from gross bodily harm.

One person telling the story eliminates any issues otherwise! Heaven forbid you ever need to use deadly force, pray your aim is true!

And yes, State to State, the actual USE of deadly force may have particular constraints, but should you ever be faced with a spilt second decision and choice, you'll regret worrying about some aggressive DA or other bullshit other than protecting yourself!

THIS is the problem. THEY want to program you to NOT act, to give the criminal the upper hand, etc. This is not how real life works! You DO what you gotta do, and walk away. Fuck all the rest of the nonsense.

Again, playing out silly scenarios that never materialize into reality is counter productive. There's enough coaching videos out there about how to respond to authority post event should a situation ever occur. But trying to rationalize make believe bullshit won't do you any good.

Go to the range, shape your skills. Take some force on force classes. Take some form of martial arts, real martial arts, not "Take My Dough Jo's" so you can defend your weapon too... But real life protection arts are out there too. Or will we begin some stupid fucking conversation about how your supposed to register your hands as a trained killer too!

Lol...

If the intruder was unarmed and the threat was not immediate, courts may find your use of deadly force excessive moxielawgroup.commoxielawgroup.com.

Why charges can still happen
Even if you act in self-defense, you may still face:

  • Criminal charges if the force used is deemed excessive or unjustified.
  • Civil lawsuits from the victim or their family, even if you acted in self-defense mylegaltips.commylegaltips.com+1.
  • Investigations by police, which can lead to charges if evidence contradicts your defense moxielawgroup.commoxielawgroup.com.

In this state it probably would depend on the county DA. Even if under any reasonable scenario and the homeowner is obviously totally justified, certain county DA's would indict, knowing the process will be the punishment. Such is the state of the judicial system in shit-hole USA.

Many (maybe most) jurisdictions allow deadly force during any burglary, whether the intruder is armed or not.

Because they don't expect the homeowner to have to figure that out at the time.

Even NY Pl35.20.3

Says:

3. A person in possession or control of, or licensed or privileged to
be in, a dwelling or an occupied building, who reasonably believes that
another person is committing or attempting to commit a burglary of such
dwelling or building, may use deadly physical force upon such other
person when he or she reasonably believes such to be necessary to
prevent or terminate the commission or attempted commission of such
burglary.

Man Who Shot Intruder In His Home Sued For Wrongful Death | Gilman & Bedigian

A judge has decided that a man who shot and killed an intruder in his home, can be sued by the dead man's family.

Yep be a man and kill the SOB in your home....oops not so manly an outcome.

My guess is the fact the shooter was drunk and shot the guy in the back is what impacted the judge's decision. Still a bad decision in my opinion by the judge. Break into someone's house drunk and start attacking him justifies a shoot.

Yeah, the guy breaking into your house just wanted to borrow a cup of sugar, just ask him ...

But when the cops arrived they found him on the kitchen floor with some holes in him DOA and a kitchen knife laying in the floor next to him...

Now, let me ask you ... Who's story gets believed? The one who can talk, or the cold stiff on the floor?

Throw all that other bullshit away, stop worrying about what comes next or you'll be the stiff on the floor because you hesitated, or had to think before you acted. And be sure, REACTING to a threat is an extreme disadvantage, one that could cost you (your life). There's nothing in any legal case that says defense is only in reaction to a threat. Only that the threat exists. You don't have to wait to be bludgeoned or stabbed before defending yourself! But that's what they want you to believe...

Let alone when you are in your own domain, have a right to be there, and are not the aggressor ...

Equally important, or even more important, to our big government overlords is that tens of thousands of news watching gun owners will be intimidated.

Exactly that!

Is why you rarely see any defensive use of firearm make the news! Like the grandma wherever it was defending herself from 3 who kicked in her front door, etc. Good shit happens every day! News loves the negatives and hyperbole bullshit hyper sensationalizing everything these days!

Theoretical, "what I would do", pales in reality.

I have had so many things disappear from my home in petty thefts while I was away, over the years, I finally purchased a $200+ dead bolt that supposedly cannot be picked, came with a key card to get a new key made.

Are Assa Abloy Deadbolts Unpickable?

Assa Abloy is a major manufacturer of high-security locks, including many deadbolt models. While no lock is completely immune to all forms of forced entry, certain Assa Abloy designs are engineered to be extremely difficult or nearly impossible to pick with conventional tools.

Seemed to work as the ez access to my home ended. An earlier previous attempt to sabotage my new boiler was made, but easily fixed...a real ANGRY dumbass...that was the final straw and the new deadbolt arrived shortly

The theft of canned goods, and kitchen items seemed to indicate a homeless/poor person.
No guns or gun items were ever stolen. Recently purchased tools in a box disappeared twice before I wised up Aggravating to no end.

After the installation of my Blink Camera system, outside gasoline thefts ended, and minor vandalism ended too, abruptly. An attempt or two was made to hack into my cam system but failed.

No one wanted it seemed to break in while I was home. Very wise or paranoid!!

The burglars are out there and many are skilled and do not want to die.

I do not want to shoot anyone, brandish at anyone, and go thru the "process".

Are burglars seriously "picking locks" in your neighborhood ?

Do they wear those little masks that just cover your eyes too ?

Or do they just break a window like normal criminals ?

You really do live in some special comic book neighborhood.

I am generally safe now from petty thefts.

Many many tricks,; Quickset and Shalage door sets are just a joke. Even the credit card trick will work.

10 Top Tricks That Burglars Use

Burglars use a wide array of tricks to take advantage of property owners. Learning more about these tricks will help you beat them at their own game.
unitedlocksmith.net unitedlocksmith.net

I figure that the main culprit just took the spare key I had to the front door years ago hanging on a key board ; always daylight robberies.

Very smart thefts..
Even up to last month, on occasion I had been hearing a womans voice talking to someout outside in the back yard at 2 am. Dumbest woman on earth?. The last time, I shouted out, when she said it was "ok"................."It's not OK"!!

Previously I had shouted before "what makes you think I cannot see you?" I could not, but that worked too.

I live in rural section of Rome, and near a trailer park and the South Rome drug community. I have been told that cameras have recorded up bicyclists on the road at 3 am.

A neighbor several years ago had a golf cart on a trailer, ready to go to the Farmers Convention in Seneca Falls. Next morning the golf cart was gone..................found in the Mohawk River later near the Savoy Restaurant.

We all have working camera systems now.

Be safe.

The point is "it doesn't matter how cheap your door lock is, they'll break the window before even trying it" so quit wasting your money.
