This is at least progress. All gun laws are unconstitutional.
It’s always been a dream of mine to get on a felon in possession jury and try to nullify it.
In theory I think a ban for a specific individual as part of their sentence for a specific conviction is probably constitutional. All gun laws are unconstitutional.

If we allow someone to live outside the fence they should have all the rights the rest of us do. If they can’t follow the rules…keep them in the box.In theory I think a ban for a specific individual as part of their sentence for a specific conviction is probably constitutional.
After all, if you can lock them in a box against their will for 20 years, you can probably say "no guns".
Likewise as a condition of parole it would be allowed.
Not that I think that's a good idea, but they aren't actually a violation of someone's rights.
But, as a blanket condition of *all* felony sentences, yea, it's absolutely constitutional bullshit. The prosecution should have to specifically request that as part of the sentence and it would have to follow the normal sentencing process on a case by case basis to be constitutional.
"For armed robbery in the 1st degree you are sentenced to 5 years imprisonment, and a 20 year prohibition on the possession of firearms or ammunition" is a reasonable sentence. Just tacking it on to everything isn't.
I agree with you as a practical matter. If they can't be trusted with a gun they can't be trusted to walk free.If we allow someone to live outside the fence they should have all the rights the rest of us do. If they can’t follow the rules…keep them in the box.
SC recently changed the law to a second possession convection is now a mandatory 5 years. It should be the first is 5 and the second and subsequent should be longer.
This is great thinking. How many times have we seen the oh he was arrested 50 times before he killed that person. Well, why was he released? He’s proven he can’t behave. If we allow someone to live outside the fence they should have all the rights the rest of us do. If they can’t follow the rules…keep them in the box.

Agree. There are many ways to kill people. Look at the uk. They effectively removed guns, knives are an issue, now they are banned, tools were an issues, so they are banned from being carried, now crossbows? Humans killed before guns and they will kill after guns if that’s ever a thing.I agree with you as a practical matter. If they can't be trusted with a gun they can't be trusted to walk free.
But, from a strictly constitutional law point of view, such a sentence probably does not cross into "cruel and unusual" territory, and the whole point of a criminal sentence is to strip someone of some of their rights.
So it is dumb, but not unconstitutional.
Are you pleased that they are allowed to walk freely among us even knowing their violent nature though ?Violent felonies include many drug arrests, especialy where guns are found and resistence is enountered. Same with drug sales. Domestic Violence is just what it is..violent felony.
DWI convictions generally stay with you and NICS is out of the question.
Non violent felonies might include embezzlement, fraud.
Suffice it to say between 40-80 million canniot pass the NICS test, and must obtain their guns illegally, creating another felony situation.
I am please that this many creeps and total shits are legally without rights to own weapons ..............forever.
Fuck them.
I had a friend who was a prison guard and about 2 years ago he quit. He couldn’t handle it. It was so bad he quit without another job. He said he was going to get killed, another guard or an inmate. He said it was not safe in the least bit. Horrible things were happeningFrom watching movies people think prisons a full of gentle old souls feeding the birds on Alcatraz Island. Talk to a prison guard some time, after he is sure he can trust you or sees you a fairly like minded individual.
The majority of them should never own a gun, ever! Let alone walk the streets among the citizenry.
There are procedures in place where by a convicted felon can restore his second amendment rights. Believe me, those procedures are for Our protection.
