Still able to Register "Assault Weapons"?

[Robin]

Tho I haven't been in a gun shop in quite a while, I do believe some shops still sell AR rifles with a fixed magazine that must be NY Shit hole legal or they would have been raided years ago. Seems like a little investigation into what kind of mag lock the manufacturer of these NY Shithole legal rifles would be easy enough to find if one is truly interested.
Try a little internet searching, beats having this subject arise every six months or so and no one answering with anything definitive after If's and but's.
Its' wrong, unconstitutional and just another step toward the confiscation of firearms from honest citizens.
So start searching and let the rest of us ignorant bastards know, once and for all!

Granted it's a gray area, but its been done (bullet Buttons) since the 01/13 inception of the SAFE Act.
The Shop that got jammed up way back then was in Monroe or West Monroe if I recall, and not that it should matter, but the Owner was Black and was followed by that community. The most egregious example was the kid that shot up the Tops market in Buffalo, and then Koonta-Kunty James went after the Maker of the device instead of the fucktard that drilled it out so he could commit murder...I suppose we should expect it, after all it's NY and all about the Money.

I'm glad I don't have to worry about any of this right now.

Don't get complacent, there ARE Politicians in PA that want to mimic New York's Laws and Restrictions.

Yes, you’re correct and I agree with this. The gun show I went to had many riles sold with the magical I have on mine and I can tell you lots of NYSP and Erie County sheriffs would walk by them. The owner was never arrested and his guns never confiscated.

I’d say the bullet button is a no go. All you need to do for the ones I’m familiar with is take a round and push on it and you can drop the mag. Then you can insert a new mag so to me this doesn’t meet the law.

Personally I don't own any guns. I shoot rifles which I borrowed from a gentleman in upstate nursing home.

However simple as it may seem, a "Tool" (cartridge) was required to remove the Magazine, it could not be "detached" by simply pushing the Button as designed.
It becomes apparent and after a decade of use that unless you're committing other Crimes or greatly increased the interest Law Enforcement has in you that it's a non-issue and a precedence.
The reason the Magazine Locks that require the action to be split (shotgunned) is that no tools are required, only that a push-pin be shifted and the action tilted open to allow the magazine to be released.

Edited to add: When the nut inside the Bullet Button is screwed all the way down, there is no travel possible for the magazine catch, thereby locking it in place. Locking it down and filling the hole would prevent removal without damage and significant effort.

[Darth]

The NYSP will not issue any sort of ruling/law, just a vague interpretation they'll use to arbitrarily deny you...It's easier to tell you "no" than possibly be put on the spot for an answer.
"Detachable" isn't defined in the Law.

detachable

adjective

1. That can be detached.
2. Designed to be unfastened or disconnected without damage.

removable

adjective

1. Admitting of being removed.
2. Able to be removed.
3. Capable of being removed or taken away or dismissed.
   "removable partitions"

Bullet Buttons that keep the Magazine from being detached (dropped) from the Rifle without the use of Tool(s) to remove the magazine have been installed by the thousands since the passage of the SAFE Act...the few people that have gotten jammed up did so because THEY fucked around with the modification...There isn't anything on a gun that can't be "removed" which differs from "detached" and this is something the State really doesn't want to go to Trial because it could expose the whole Law for the bullshit that it is.

If a rifle has a magazine in it, it does not have "The ability to accept a detachable magazine. "

No one here is going to slather an AR mag body with JB Weld or epoxy, because they want the ability to take it out.............. someday, and do not want to run a $50, AR Lower receiver due to "principle."

If the mag well and mag are slathered with good epoxy totally all sides........no one with tools is going to be able to take it out without likely destroying either the mag, or lower receiver.

If the epoxied lower is put into an oven at 300-350* for an hour, the epoxy will turn to rubber and the receiver will survive. Out comes the mag.

Intent goes a long way.............epoxy makes a good effort at legality, if it cannot be accessed and removed with a knife, along side the mag and mag well.

But then.........if arrested with an epoxied AW.........and reasonable efforts to remove the mag are futile..........the law still says CAPABLE................you have to fuck with CAPABLE in the courts.........incapable of removal, may get you off......maybe... but the oven test looms... a poor epoxy job, on an oiled up receiver well............ is legal suicide. It has to work.

So what are the manufacturers that sell AR's legally to NY Shithole licensed firearms dealers that in turn sell those very same AR's to the citizenry?
They sure as hell aren't slathering them with oven resistant epoxy!

Absolutely. You can’t remove a magazine without a tool but you can have a fully functioning firearm sitting around because you close the upper and lower then insert a magazine. This is what I question the legality of the bullet button on. I feel having the gun closed and in working order without the action split while being able to insert a magazine makes it violate the law.
To me this makes the rifle can capable of receiving a detachable magazine. The law doesn’t say anything about how the magazine is removed but is it capable of receiving a detachable magazine. Being able to receive a detachable magazine and having a nasty feature is how NYS defines an assault rifle. Having the gun back together, fully functional, and able to receive a magazine violates the law the way the law is written.

I might be wrong.

I didn't read through all these, but I'm probably the least computer adept user on the site and counting my two finger typing it took lass than five minutes to find this stuff. Seems to me that if I was in the market to possess a NY compliant AR with a few bells and whistles it wouldn't be much of a problem. C'mon fellows, is it truly more fun to go on a forum and fear monger(?), get out there and do some searching!!!!!! WTF

Primarily because of the lack of case law in NYS on the topic. The Buffalo shooting was a perfect time to get case law on the books; they failed. So dealers have to figure it all out on their own AND assume any liability to INCLUDE if the law is changed more. That OBTW is a quote from the Safe Act “Help” desk. There are INTERPRETATIONS of what makes it legal (my answer is a Kali Key), but there is no protection (No case law) validating these. There are a lot of Keyboard experts with words used with no verification or reference to include the folks selling you the stuff to make it legal as Robin posted. NONE will take legal responsibility. NONE can show case law validating their claim; and they don’t have to. Each item they sell you IS legal to sell. How it is used becomes your problem. I agree with what you said regarding yours. However, I’m only a citizen and have no legal authority to say you are right. My interpretations could change tonight in a closed session of the Legislature or subjectively used against someone in a court not friendly to our pursuit of happiness and used as a means to discriminate against our Right to Pursue Happiness.

DD’s ranch sells probably thousands of them yearly. He brings probably 50-60 of them to every Hanburg hub show. Cops, NYSP, sheriffs walk by them and don’t give them a second look.

We sold a LOT of MSR Rifles that as best as anyone could tell including NYSP Officers that visited in Uniform and plane clothed Detectives complied with SAFE.
What really nailed the coffin shut was the "Semi-Automatic Rifle Licenses" that shut out a lot of new owners and quite a few ordinary people that for reasons mostly of the exasperating trouble in obtaining a Handgun Licenses (that was allowed to substitute the SA Rifle Licenses despite the Law) could not buy even a simple 10/22 Rifle let alone a AR series. Congratulations, Democrat Lawmakers, you fucked Honest Citizens while thinking you're stopping crime committed with guns.

Oh I’m sure that’s it. Many people will not go through the process of obtaining SA license for a 10/22 when pellet guns are almost equivalent these days. I’m not sure I would.
My oldest son just said he’s going to complete his pistol license paperwork while he is on Christmas break and get it submitted. I’m thrilled.

Well, those MFG's do not certify that their mag solution is NYS legal..so we are in the same boat..............no determination yet............still up to the discretion of clever En con officers. and prosecutors.

No one of those MFG's will come to a court hearing, and testify that they had their solution approved by the AG.

I don't see them on the rack in NYS anymore, after the Buffalo and the Mean Arms mag Lock removal ...........only Thordsen stocked guns , if any. THAT Buffalo gun, was a factory mag locked gun............the start of our misery.

Aunt Jemima sued Primary arms and Mean Arms/Mag Lock........More states like RI banning AW's.........SCOTUS has to step in.....

Don't go down with the ship...........
