I wouldn't even call that misuse. Why not just focus on the underlying crime? Should a racing suit and helmet become illegal because someone wore them while blowing through a stop sign to evade the police? What about rape? Should the punishment be increased (or even decreased) if the rapist wore a condom?
So we want to enhance public safety by prohibiting, restricting, and requiring licenses for Guns, but anyone that wants to protect themselves from possibly being struck with a Bullet is a criminal?

Despite 100% accountability and strict adherence to Federal and State Laws, the Left still wants to blame Manufacturers and Dealers for mis-use of Guns by Criminals who invariably obtained those guns illegally from people that illegally transferred them.
Only thing worse than someone deceitful is a thief; democrats with their duplicity are both, sadly the only change I can see to NY is the exodus of those who've had enough of the progressive bullshit from the left, leaving only those who depend on the system, and those that cannot escape paying for it.

NY has long presumed and treated it's Citizens as not yet convicted felons and made assumptions that if you had a gun, you were going to use it illegally, and if you're wearing Body Armor you're hedging your bets on getting shot while committing a felonious crimes.

Will that body armor be grandfathered in, or will the people who have owned body armor for years in some cases, have to get rid of their property, possession, protection, and squander the money that was spent?
To stay within the law, will they be required to sell, destroy, or turn in the body armor?

IIRC early legislation allowed First Responders Body Armor to some degree...we have Vests in the Ambulance Bays and a few inside the Rigs, so I never got too worked up about the prohibition and wouldn't have even if FR's weren't included, I'm going to wear one when and if the situation dictates, and I just dare Deputy Dog to try and make a case over it, please do, we'll have a media campaign to expose this bullshit for exactly what it is.

I think that wearing body armor would strengthen the argument of "in fear of life or great bodily injury" in a sort of way.

I've seen some decent diy videos for making both hard and flexible body armor at home using readily available (common in many home garages and shops like welding fiberglass blankets and resin) for both level IIIA, IV. Some seem serviceable, it's an easy enough diy and can test out fine.

Back before the era of UBER and LYFT, I drove a cab overnights for an extra income source. That shift took me to some unsavory areas of greater Buffalo. My cab was equipped with a piece of ½" plate steel strategically placed in the back of the front seat. It wouldn't have stopped a head shot, but would have protected me from a torso shot form some POS that wanted a free ride.
If I were driving a cab or an UBER/LYFT today, I would without a doubt want level IV ( or at least IIIA ) protection. Why is it that some F'ing POS uses armor in the commission of a crime ( thinking TOPS shooter here ) and because of that someone else's job has to get more dangerous ?
