Just so you all know NYS has the same rule. I was talking with my father last summer and he was at a briefing that this is what will be happening based on the orders of some niagara county judge ruling. I argued with him that it was unconstitutional. At the time of any domestic abuse wether your arrested or charged with a crime or not they are taking your guns now. I said how can they do that if your not charged with a crime. You then have to go petition to try to get them back. That won't happen from what I'm told. I said it's bullshit.
I had a friendly discussion with a member of my local PD, and he relayed something very similar to me as well. He said that what they see happening, is that when somebody with a CCW gets their guns taken, they are taking ALL of their guns,- not just the handguns. Then, the person goes through the meat grinder to get their CCW back, and if successful, they return their handguns, BUT, since the long guns aren't on their CCW permit, the departments are refusing to give them back to the gun owner UNLESS the court orders them to do that!!!
What a bunch of shit that is! He told me that the officers in his and other departments that he is aware of are then taking those long guns when the rightful owner gives up fighting to get them back! That is fucked up!
I recall reading about the case of a guy in Blasdell last year that went through that when cops were called to his house when he was in the midst of a nasty divorce, and they seized all of his guns, but did not arrest him. His CCW was suspended. When it was restored after he went through hoops to get it back, he got his handguns back. But the Buffalo News article pointed out that he had to file separately in NY Supreme Court to get his long guns back. That cost him a small fortune, AND, it took him about 2 years to finnaly get a court ruling that directed the local PD to return his long guns back to him.

Sure, they are. Either a reason still exists for them to take them, or it doesn't. If there is no valid reason to take them now, then they should give them back with no fuss. However once taken they need a court order to give them back. I don't think it should be up to a cop to decide weather or not to give them back. In cases of mental illness or other situations cops are not qualified to return them or not.

If they had taken something else, and the reason they took it was determined to be false, or no longer valid, it shouldn't take a court order to get them back. Why would guns be different ?
