Mandated covid19 vaccines for all NYC employees

[Defilade]

This is not the case: 3028 - If my employer requires proof of my COVID-19 vaccination status, does that violate my rights under HIPAA?

In other news, NYC going to require vaccination for certain indoor activities.

New York City Mayor Bill de Blasio will mandate Covid vaccines for certain indoor activities

New York City Mayor Bill de Blasio issued a mandate requiring employees and customers of indoor eateries, gyms and entertainment centers to get vaccinated.

Yes it does violate!

[Defilade]

Not the case. My girlfriend works at a gym. They can 100% ask for vaccination status.

They can ask all they want. It's medical discrimination, and they can be held accountable. To say you are not allowed in here because you do not have a vaccine is like saying to the disabled man in a wheel chair you can't come in here because you can't walk.

Yes it does violate!

The 4th has nothing to do with this on its very face. As for civil rights I was not familiar, so I googled and this first hit debunks the graphic:

Federal law allows businesses to ask for proof of vaccination

False. It does not violate the Fourth Amendment or the 1964 Civil Rights Act for a business to ask customers or employees for proof of vaccination, according to legal experts.

CLAIM: The Fourth Amendment of the United States Constitution and Title III of the U.S. Civil Rights Act prohibit businesses from asking people for proof of vaccination.

AP’S ASSESSMENT: False. It does not violate the Fourth Amendment or the 1964 Civil Rights Act for a business to ask customers or employees for proof of vaccination, according to legal experts.

"
Legal experts say federal laws don’t block businesses from asking customers or employees about their vaccine status, despite social media posts claiming the opposite.

Posts circulating widely on Instagram this week cited excerpts of the Fourth Amendment and the 1964 Civil Rights Act to falsely claim that a business asking for proof of vaccination or denying entry based on vaccination status is a “violation of your privacy and property rights” protected by federal law.

The posts claimed the Fourth Amendment protects individuals against businesses asking about vaccines because it protects “the right of the people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures.”

However, legal experts say that amendment refers specifically to searches and seizures by the government, not by private entities."

Your vaccination status is part of your own private medical record, ergo falling under the protection of HIPAA.

Not so. I posted a link yesterday from US health department .gov website disputing this specifically.

seems to me this asking about vaccinations would be in the same category as asking about about service dogs

A public accommodation provider cannot ask about the nature or extent of a person's disability and may not demand proof that the animal is certified. ... Under the ADA and New York law, businesses and facilities that serve the public may not discriminate against individuals with disabilities.

Keep complying and nothing will change… just like gun laws

AP’S ASSESSMENT: False.

What? This is hardly debunked in any way. It conflicts with Hippa laws to begin with. Something like this is going to have to be hashed out in the courts , not on the internet. Associated Press is not really an authority on constitutional law.

The supreme court did allow the forced Vaccinations in emergencies. This "pandemic" does not meet the requirement for an emergency by a long shot.

But that law, known as HIPAA, only protects health information that is “in the hands of health care entities, like hospitals and other health care institutions,” according to Alan Meisel, law professor and bioethics expert at the University of Pittsburgh.

True! but your vaccination record is recorded.

This is propaganda

Legal experts is the source, much like CNN's FBI sources

This is a bullshit article.

The truth is , this is going to have to go to court to be settled. No easy way out here.

Look,

The Privacy Rule applies to all forms of individuals' protected health information, whether electronic, written, or oral. ORAL! Thats right from the goverments website 2nd paragraph

Come on now man. Your smarter than that. I dont mean trust meme's , but shit, If you dont realize by this time that the press is just a branch of government, I dont know what to tell you. in Fact if you believe the press , I dont think there is any possible way to sway your opinion , your pretty much lost. nothing any doctor or medical professional or victim could sway you to believe they are being dishonest.

You may as well fact check at snopes if thats as far as you want to dig.

You appear to be using HHS.gov as a source of final truth on this matter. This is their opinion on the matter as to whether vaccine status conflicts with HIPAA:

The media in this country is not great.

It's still head over heels superior to random graphics online--particularly ones that are debunked based on the precedent of case law and by lawyers, which is what AP referred to when debunking this.

Dr. Sharon Alroy-Preis, Director of Public Health Services in Israel
That statement stands in stark contrast to what the Director of Public Health Services in Israel told television viewers of the CBS program, Face the Nation, on Sunday, reporting that 50 percent of new infections in Israel are from fully vaccinated people.

DR. ALROY-PREIS: So there are two major concerns. One is that the Delta variant is 50% more infectious than the previous, the Alpha variant, which was 50% more infectious than the original one. And we still have a third of our population that is not immunized or has not been recovered. We have a large children population. And so that is obviously concerning. The other point is that we are seeing about 50% of the people who are infected right now are vaccinated, fully vaccinated individuals. And so that is obviously of concern. Previously, we thought that vaccinated, fully vaccinated individuals are protected. We're now see- we now see that the vaccine effectiveness against disease is roughly 40%. It still remains high for severe disease. But we are seeing diminished protection, especially for people who have been vaccinated earlier.
