No one is surprised by this. It was a foregone conclusion the same day charges were announced.

Could say the same for the trial of Sarah Osborne.
The real question is, will this precedent be applied universally, or will some demographic groups be immune ?

Why, the legal community was just handed a whole new market. Almost as big as the New Jersey junk yard decision back in the fifties!

Thats what I want to know. If you buy your child a car and they run someone down, shouldn't you be liable by this logic?

No one is responsible for anything, its' Adam and Eves' fault! all of everything.

If I remember correctly, back when he was first tried, they are claiming he KNEW his son was unhinged and bought him the rifle anyway.

If the car is yours, and you lend it to someone, you are responsible for their actions.
1977 I was active duty USCG up on Wellsley Island. I had an impacted wisdom tooth. USCG does not have medical/dental staff (emts, medics yes) and normally must go to US Public Health Service. I was sent to (then) Camp Drum for dental care. Since I was to be sedated I was required to have a driver. Seaman Smith asked me if he could use the truck to go to the PX. I said yes.
Seaman Smith not only went to the PX , he drove around and took a sewing machine out of what he thought was a burned down abandoned property.
A month later we were both arrested for burglary. I was an accomplice because I let him use the truck, it doesn't matter if you qualify their usage to "go to the PX". Once you give them the keys they can do whatever they want and you will be held accountable for whatever wrong they do.

Thats rather odd. Was this a UCMJ action or off post? You were arrested or convicted? A person is not liable for another actions with a loaned vehicle as long as they were not privy to their crime, but can see the person being questioned or even arrested during the investigation.

Was exactly my first thought as well.
If this father was aware that his son had malicious intent and gave him a rifle anyway, ok. But this juat feels wrong.

NYS Police, Arrested and pled guilty to a lesser charge
Judge kicked my lawyer, the State Trooper, and the local prosecutor out of the courtroom and told me I was guilty. He gave me a one-time offer to plead guilty to Trespassing and pay a $50 fine or he would bring everybody back into the courtroom , pronounce me guilty of Burglary and sentence me to 2 years in prison. Told me it didn't matter if I only gave him permission to go to the PX.
I paid the $50, He recorded it as a $25 fine, and that I did not pay it.
Group Commander denied my promotion.
20 years later a warrant was sworn out for my arrest for the original charge because I did not pay the fine.

Wow, that's bad. I've experienced some similar shenanigans in the past, but not that bad, thankfully. Story time:
I was driving a group that was out drinking, and went to get my truck. Stopped across the street from the bar they were coming out of. As my gf (now wife) was crossing the street, a car was moving along in her direction and came to a sudden stop where she was crossing. She flipped the driver of the car off. Naturally, it was a cop.
He pulls up alongside me and the following exchange occurs:
Cop: "I could arrest her for that" <clearly trying to bait me into something>
OTR: "Go ahead."
<gasp from my gf in the back seat>
Cop: "I could arrest her."
OTR: "She's right there in the back seat."
<my gf was not happy with my responses here, but as I explained to her later, a tough guy "you'll have to go through me first" reply wasn't going to help anything>
Cop: "You can't park there."
OTR: "Got it. Will move as soon as everyone is buckled."
Cop: "You can't park there."
OTR: "You're blocking me in. I will move the vehicle once you get out of the way."
The cop, obviously pissed off, pulls out of my way and then pulls into a parking space about a block down. After I pass him, he started tailgating me. I assumed I would be pulled over, put through a field sobriety test, etc. But, nope, he just continued to tailgate me until I reached the city limits, at which point he turned around. I thought that was the end of it.
Fast-forward three or so years, I get a notice from the DMV that my registration will be suspended due to failing to pay a fine. Since I always pay my bills and fines on time, this was a surprise. So I started digging in. Turns out, the cop had written me a ticket for parking in front of a fire hydrant. I never received notice of the ticket, or notices for court appearances, nothing... and I had not changed my address at all during that timeframe. I was apparently convicted in absentia and fined, and never found out about it until my registration was on the line.
I filed a complaint with the PD, who promised to pretend to look at it.
I went back and looked at the spot. There was not a fire hydrant there in the traditional sense, but there were a couple of hose pipe connections coming off the building that I assume are for fire hoses, and - at least at that point in time - there was red paint on the curb. So I guess the ticket itself was probably legit.
