AR Pistols in NY - Are they legal?

Gentlemen,

I was wondering if anyone has built an NY legal AR pistol (or if that is even possible.) I wanted to make one with a pinned mag and use bear flag loaders with it for HD. Also wanted to put a brace on it.

LMK if this is ok or a no-no.

If you are building it you must have the stripped lower delivered to you as a pistol, not an other. Get it on your permit before you take delivery from FFL as FFL has to report it to NYSP. Gotta be a fixed mag.

Why does it have to be pistol? Back when I was in NY and built an aks74u pistol (my avatar) I got a noDak Spud receiver that was other. Of course when I got the hell out of that state I made it the real thing but why does it have to be pistol?

Polls are supposed to reflect the subject matter of the thread. If you throw any old poll in there, it ruins the thread.

For example...

You make a thread asking a technical question about ammo.

There is a poll on there about something else.

Half the people will comment on the poll instead of the technical aspects of the ammo.

Now the thread is fucked for someone else looking for the answer to the ammo.

My FFL told me the most important things are to buy a stripped lower sold as a pistol. And to have it shipped to an FFL willing to do the transfer and associated PP paperwork. I was told some FFLs are not willing to do so.

It’s mostly a paperwork and reporting issue in New Yorkistan. FFL must report all pistols to NYSP upon receipt from distributor and put on his “books.” This way when he sells or transfers to you as a pistol it gets matched (theoretically). Trying to put a pistol on your permit that doesn’t exist in NYSP database is no bueno.

Yes, Basically.

You can build your own, it is tough to get the pistol office to understand, and to cooperate.

So did I pull a fast one or? I remember the paperwork I filled out had "other" on it. To my understanding "other" just means it was never built as a pistol OR rifle. I know here at least you just make sure you get an "other" or "pistol" designated receiver so that you can build it into a rifle later on if you wish. Just wondering why in NY you have to specifically get a "pistol" receiver. If so how did the FFL file the paperwork when it was "other"?

You do not have to get a “pistol” receiver. There is no such thing.

A receiver is just that.....a receiver. It goes as “other” on the 4473 and in the a&d book. Another other eay and it is incorrect. Period.

If you get a glock receiver......is it marked or called pistol? Why is an ar different?

Ok so I guess what I mean by other is a virgin receiver that has never been built as anything. A rifle receiver would be one that is registered somewhere already as a rifle, someone stripped it down and then sold it to you. A pistol is one that is registered somewhere already as a pistol stripped down and then sold to you. I suppose it's all moot. Just get one and do whatever you want lol.
