What makes DOJ’s Virgin Islands case different from most Second Amendment lawsuits?
DOJ is not merely challenging one gun law. It is using 34 U.S.C. § 12601—a federal civil-rights enforcement statute—to allege that law enforcement engaged in a pattern of official misconduct through permit delays, unwritten conditions, subjective denials, compelled home inspections, and other restrictions.
In other words, the licensing process itself is being treated as the potential civil-rights violation.
That should matter in New York, where government officials control access to lawful self-defense through references, interviews, character review, local intake procedures, and a six-month clock that may not start when applicants think it does.
The article separates allegations from findings, compares both systems, answers the strongest gun-control objections, and explains why binding lower-court precedent can still conflict with Supreme Court guidance.
