this is exactly what I was thinking. I have no doubt this guy has a logical and intelligent argument, but he's going up against a system that will say "you are absolutely correct, but we don't care! go away"

I think what needs to be brought to the table is the use of firearms in a DEFENSIVE manner. The media is ALWAYS bringing up firearm issues that pertain to murders.

From the bottom of page 4 in the brief,
The SAFE Act, amending Penal Law Section 400.00(16-a)(a) to provide for registration of weapons uses the term “possessed” and does not specify that such possession can only be inside New York State.
Does this mean if you have an out of state address other than your permanent NY address, you can't keep your non NY compliant guns out of state even where the gun would be legal? If that is what this means, how the hell can NY enforce a law out of state? Seems like Andy is over stepping his boundaries there if thats the case.

The "gun store owner" who ratted the veteran to the NYS police deserves to be hung for treason, typical FUDD bending over to NY's Nazi laws, all he had to do was kick the man out of his store and advise him to make his rifle "compliant", and keep his mouth shut. Don't ask don't tell, no one was hurt. I fucking hate fudds that betray and sell out their fellow citizens.

One of the defendants represented by James Ostrowski was convicted for criminal sale of a firearm for attempting to sell a non complainant AR15 to an undercover NYSP officer. Long story short the defendant tried to sell the rifle to a gun store, the clerk told him he could not buy it from him since it had all the "banned features". Instead of advising him to make it "compliant", get it out of NY ASAP, sell only the receiver, among the many other legal options he reported him to the NYSP.
Yes the guy most likely knew about the unsafe act and he is an idiot, but he does not deserve to be branded as a convicted felon for doing something perfectly legal in 90% of America.

I've been working with lawyers for 20 years so... no.
The only way to win this is to bribe the judge. Good lawyers can do that without breaking any laws or in such a manner where it's hard to prove. Bad lawyer rely on depth and merits of their legal arguments. Anyone who thinks money didn't change hands in O. J. or Skakel cases is a fool.
