A New York Supreme Court judge, however, has tossed out the charges against Nolan and ruled that under New York state law, the Shockwave isn’t actually a firearm.

I wonder what the backstory is, the shockwave is openly sold all over NYS. Suffolk county pistol licensing bureau even typed a letter to FFL’s stating that in their opinion the shockwave was legal to own without a pistol license, and it did not meet the NYS definition of a short barrel shotgun.
