Evidentiary procedures are very strict for multiple reasons, one (relevant here) being court proceedings.
This rifle was recovered during an arrest, so is therefore evidence in a court proceeding. The cops CANNOT modify it, period.
The cops can modify a citizens property unless required for an investigation. They can’t “split” the upper and lower to play semantics games. A rifle is a rifle.

That's not true. The courts, prosecutors and cops will consider other regulations and rules. If DEC hunting regs were to specifically state that open carry is legal while afield, then that provision would be legal.
We have to yell, "Police! Don't move!" whenever reasonable and prudent. Granted, "reasonable and prudent" is pretty subjective, but nowadays, I'm not willing to bank on the subjectivity of those judging me afterwards matching up with my subjectivity during the incident.

I just sold two rifles but with the ridiculous laws we have it's much easier for me to sell locally to cops. They went quick. Also, people pay higher prices here because they don't really know guns or the market well enough. ;)

I’m torn selling the Camp 9, but I can get a lot of money for it and really won’t have any use for it. I’ve never been one to keep guns that are just taking up space.

The NYPD couldn’t initiate an arrest for that violation section. It would have to be ordered by a district attorney (perp would turn themselves in most likely).

The general rule is that any evidence observed while a cop is in a place they are legally allowed to be in is admissible. The fact that the perp was the victim of a separate crime is irrelevant.
