Im a bit worried but I have a good feeling about this one for some reason. I’m usually very skeptical, but I think he will grant it. Of course this is just a feeling but the Virginia ruling and Suddaby’s past comments on this have to mean something. I guess we will see at some point soon.

Do you really think he was just going up smack his little mallet on his coffee coaster and yell, “Screw you, crappy Kathy! It’s all shit down!”????? He needs some time to write up his TRO in such a way as to thwart the State’s immediate appeal the the 2nd Circuit, (which will probably happen, and will be heard there even while the district court is still arguing the original case.) It’s a real mess, and it’s neither quick nor easy to be resolved.Judge is stalling, not giving a decision. Excuse my attitude, I am not surprised. And this is on a TRO, not Injuunction. If he truly believed the law was unconstitutional, a complete Injunction should have been given. I would love to be wrong on this one but I think I called it earlier and it was not positive.

If he issues an injunction and the state authorities ignore it, will he send out the US Marshalls to arrest the governor, AG, State Police Chief etc and hold them contempt and in custody until they comply? They have gotten a lot easier since Buren. And tirwin1, your are right, the judge could do it, but not going to happen. I agree.
I think in view of Buren the SAFE ACT is in serious trouble. No such law in history and tradition outlawing a class of arms. In fact I think the 1934 Firearms may be in trouble.
